Privacy Policy
This policy explains what information Calent Health collects through this website, our patient portal, and the text messages and emails we send, and what we do with it. Calent Health is Banda Berry Health Services, Professional Corporation, dba Calent Health (“Calent,” “we,” “us”).
Your health information
Calent is a psychiatric practice and a covered entity under HIPAA. Health information we hold about you as a patient (“protected health information”) is protected by HIPAA and by state law, including California’s Confidentiality of Medical Information Act. How we use and share it, and your rights over it, are set out in our Notice of Privacy Practices. If this policy and the Notice ever disagree about your health information, the Notice controls.
This policy covers everything else, and the practical details of how the website, portal and messages work.
What we collect
When you visit the website
The public website doesn’t use analytics, advertising or tracking cookies. Like any website, the servers that deliver it record basic technical details of each request, such as your IP address, browser type and the page requested. Our hosting provider keeps these logs for operating and securing the site. The site’s fonts are served from our own site, not from a third-party font service.
If you use the appointment request form, we receive what you enter (such as your name, email address, phone number, state and preferred clinician) and use it only to respond to your request. The form does not ask for clinical details; please do not include health information.
If you email us, we receive your email address and whatever you choose to write.
When you use the patient portal
The portal collects what you give it, such as your name, date of birth, contact details, intake answers, appointment choices, and anything else you enter or upload. It also keeps sign-in and security records, such as when you signed in and from what device or network, so we can protect your account. This is part of your health information and is covered by the Notice of Privacy Practices.
Text messages and email
If you agree to receive texts, we keep your mobile number, a record of your consent (when and how you gave it), the messages we send and receive, and delivery status. Texts you send us may become part of your medical record. For email we keep your address, the messages we send, and delivery status. See our SMS Terms for how the text program works.
Payments
Visits are self-pay. Card payments are processed by our payment processor. We receive a record of the payment, such as the amount, date and the last four digits of the card, but not your full card number.
How we use it
- To provide your care, schedule and remind you about visits, and answer your questions.
- To run the portal: signing you in, keeping your account secure and showing you your information.
- To send the messages you’ve agreed to, and to honor opt-outs.
- To take payment and give you receipts and superbills.
- To keep the website and portal working, secure and free of abuse.
- To meet our legal and professional obligations.
We don’t use your information for advertising, and we don’t send marketing texts.
Who we share it with
We do not sell your personal information, and we don’t share it for anyone else’s advertising.
Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent are not shared with any third party, except the service providers that operate our messaging on our behalf.
We share information only:
- with service providers who host our systems and deliver our email, texts and payments on our behalf, under contracts that limit what they can do with it, including a business associate agreement wherever HIPAA requires one;
- as described in our Notice of Privacy Practices, for health information (for example, with a pharmacy filling your prescription);
- when the law requires it, or to protect someone’s safety;
- with your permission.
Cookies
The public website doesn’t set cookies. The patient portal uses a small number of cookies that are strictly necessary to sign you in, keep your session secure and protect against forged requests. We don’t use cookies for analytics or advertising. If we ever add analytics, we’ll update this policy first.
How we protect it
We use administrative, technical and physical safeguards designed to protect your information, including encrypted connections to the website and portal, access limited to the people who need it for your care or our operations, and records of access to patient information. No system is perfectly secure, and texts and ordinary email travel over networks we don’t control. That’s why we keep sensitive details out of texts and ask you to use the portal for anything private.
How long we keep it
We keep medical records for as long as California law and our professional obligations require. We keep other information only as long as we need it for the purposes above, or as the law requires.
Your choices and rights
- Texts: reply STOP to any message to stop texts. Reply HELP for help. You can also change your text preference in the portal or by asking us.
- Email: you can ask us to stop non-essential email. Some messages about your care or account may still need to reach you.
- Your health information: you have the right to see and get a copy of your records, ask for corrections, and more. The Notice of Privacy Practices explains these rights and how to use them.
- Other information: you can ask what we hold about you, ask us to correct it, or ask us to delete what we aren’t required to keep.
Children
Our services are for adults 18 and older. This website isn’t directed to children under 13, and we don’t knowingly collect information from them through it.
Changes to this policy
If we change this policy, we’ll post the new version here with a new effective date. If a change materially affects how we use information we already have, we’ll tell you before it takes effect.
