Notice of Privacy Practices
This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.
This notice applies to Banda Berry Health Services, Professional Corporation, dba Calent Health. We must protect the privacy of your health information, give you this notice of our duties and practices, follow the notice currently in effect, and notify you if a breach compromises your unsecured health information. We also follow California privacy protections when they are stricter than HIPAA. Patients receive this notice at their first service, except in an emergency, when we provide it as soon as practical.
How we use and share health information
- Treatment: to provide and coordinate your care, including sharing information with a pharmacy or another treating clinician when permitted by law.
- Payment: to collect payment, prepare receipts and superbills, and resolve billing questions.
- Practice operations: to manage and improve our care, review quality, protect our systems, and work with service providers under required privacy agreements.
- Care communications: to contact you about appointments, treatment options and services related to your care.
- People involved in your care: to share relevant information with someone you identify, with your agreement or when the law permits us to use professional judgment.
- Other purposes permitted or required by law: public health reporting; reporting abuse or neglect; health oversight; responding to lawful court orders or other legal process; certain law-enforcement requests; preventing a serious threat to health or safety; workers’ compensation; and authorized government functions. We share only when the applicable legal requirements are met. Where applicable, legally permitted disclosures may also involve coroners, medical examiners, organ donation or research subject to required protections.
Uses and disclosures outside those permitted by law require your written authorization. This includes most disclosures of separately maintained psychotherapy notes, marketing uses requiring authorization, and sale of health information. We do not sell your health information or use it for advertising. You may revoke an authorization in writing at any time; revocation does not undo actions already taken in reliance on it.
Your rights
Contact our privacy office below to exercise these rights:
- Access: ask to inspect or receive a paper or electronic copy of your medical and billing records. Certain records, including separately maintained psychotherapy notes, are excluded by law. We may charge a lawful, reasonable cost-based fee. If we deny access, we explain why and any review rights.
- Corrections: ask us in writing to amend information you believe is inaccurate or incomplete, explaining why. If we deny your request, we explain why and how you may submit a statement of disagreement.
- Restrictions: ask us to limit uses or sharing. We generally do not have to agree, but must honor a request not to disclose information to a health plan for payment or operations when it concerns a service you paid for in full out of pocket, unless disclosure is required by law.
- Private communications: ask us to contact you in a particular way or at a different location. We accommodate reasonable requests.
- Disclosure accounting: request a list of disclosures for up to the previous six years, excluding categories the law exempts, such as treatment, payment and operations. The first list in a twelve-month period is free; we tell you about any lawful fee for additional requests before proceeding.
- A copy of this notice: ask for a paper copy at any time, even if you agreed to receive it electronically.
